A man who, was abducted 23 years ago, has failed in his attempt to keep his 'kidnappers' from being given a jail sentence.

Barry and Judith Smiley abducted Matthew Propp, 23, he was just three days old. The abduction took place after the Smileys tried to adopt Matthew but a judge ruled that his birth mother had been tricked into signing the adoption papers. The couple never returned him to the authorities.

All three moved to Albuquerque and changed their surname to Propp.

Barry Smiley was sentenced for between two and six years, and his wife was sentenced for six months.
